Jux Terms of Service – dated August 2024

So, this is the boring legal stuff, but it’s also very important, it’s here to ensure that we operate appropriately and that we fully inform you on what we do and what it is you are agreeing to do. It contains really important information about your rights and obligations and also a dispute resolution clause when things have gone wrong and you feel you aren’t getting the agreed upon service from us.

Firstly, welcome to being part of Jux, we are really excited that you have decided to use our application. But before you can, we need you to read these Terms of Service and agree to them

Who are we

We are Jux, a trading name of 1CARD Solutions Ltd. If you need it, our company number is 11950400 and our registered office is at 20 – 22 Wenlock Road, London, N1 7GU. 1CARD Solutions Ltd is the controller of your personal information, and is responsible for your personal information. All references in this policy to “Jux”, “our”, “us” or “we” refer to 1CARD Solutions Ltd as appropriate. All references in this policy to “our website”, refer to the website owned by Jux at www.Juxapp.co.uk.

Acceptance of Terms of Service

By downloading and using Jux (“Jux,” “we” or “us”), you accept and agree to be bound by these Terms of Service. Jux may at any time modify these Terms of Service. You can review the most current version of it by clicking on the “Terms of Service” link on the Jux website, www.Juxapp.co.uk or in the Jux application. The most current version will supersede all previous versions. By continuing to use the Jux application after changes are made and notified to you (on the mobile number you have registered with us), you agree to be bound by such changes. We withhold the right to refuse and or terminate any account in accordance with these terms of use. 

Service Overview

To start using Jux, you can create an account using your mobile number, or your Facebook or Google account. We will confirm and store securely (see Privacy Policy) all information.

Services

Local offers – Our local offer service allows retailers (partners) to make available via the Jux application any offer they wish to advertise. These offers are the responsibility of the partner and not Jux, but any issues or concerns should be reported to Jux via email to enquiries@juxapp.co.uk so that we can engage the partner and if required remove or amend the offer. The local offer service is provided free of charge, we may receive a fee or commission from the partners who advertise via Jux.

Jux Cashback – is a combination of cookie-based cashback tracking, and Card linked cashback tracking. Its important to remember that all purchases you do are directly with the merchant and not Jux.

Cooke based cashback tracking is where an online purchase will be tracked, as long as you use the link displayed on the Jux app.

Card Linked cashback is a service, which Jux members (you) can utilise by linking their payment card, and then shopping with that payment card. Cashback earned from these offers will then be credited to the Jux Balance and can be managed from within the app. To take advantage of the card linked cashback offers, you must register a valid credit or debit card number and then pay at that participating retailer’s store with the same credit/debit card that was linked. The Jux Cashback service is provided free of charge, we may receive a fee or commission from our partners, provision of cashback is at the decision of the merchant or their tracking agency and is not with Jux.

Gift cards – are digital gift cards offered by other retailers/merchants, that you can purchase using Jux and receive cashback on the value of the gift card once the payment is complete. Each gift card is issued by the merchant and is bound by the terms and conditions of that merchant, these terms can be found with each gift card in Jux. These gift cards can be used online or instore (depending on the terms of the merchant), it is also possible to gift these gift cards to other people.

About Your Jux Account

Jux bonus – The Jux bonus is purely a discretionally service offered by Jux, when you scan and use a local offer. Jux will decide on a regular basis what offers will earn a Jux bonus. This means that not all offers will earn a Jux bonus and the offers that may have previously earned a bonus may change. The Jux bonus will be converted to pounds sterling and will be shown within your Jux Balance.

Refer a friend – if you like Jux, then you can refer a friend, when you do this via the Jux app, Jux may give you an additional Jux bonus. Jux withhold the right to withdraw any additional Jux bonus with immediate effect. For the referral to be successful, your friend must click on your unique link, sign up to Jux and then both of you either need scan a local offer or link your card to the Jux Cashback program. Only referral bonuses for genuine sign-ups will be paid. We will not pay the bonus for any referrals where the new account has been terminated. Multiple accounts created for use by the same person or any fraudulent signups may result in termination of your account and all accounts which we deem to be linked.

Card linking – To enable you to link your card details as securely and safely as possible, Jux has partnered with Fidel Ltd(“Fidel API”) (Registered Company Number 08068829) our payment data provider that provide a secure PCI DSS-certified environment. Your use of the card linking service is subject to Fidel API’s End User Agreement which you can view at https://fidelapi.com/legal/end-user-terms-us.pdf

Fidel API work directly with the card networks(Visa, Mastercard, American Express) to verify registered Cardholder’s transactions at Authorised merchants. By linking your card you agree to authorise the card networks to verify your purchase transactions for us, and provide us with such information so that we may provide the Cashback services to you.

For the purpose of this agreement, you expressly agree that the card networks are not party to any transaction you make and are only required by us to verify your purchase transactions. You agree to release the card networks and their representatives and affiliates from any and all claims, demands, actions, and causes of action arising out of or in any way connected with your use of our Cashback service. This release includes, but is not limited to, any claims or actions based on direct or indirect loss or damages which you may suffer for any reason, including but not limited to, merchants closing their businesses and not paying the monies due, or our own non-performance. Furthermore, you expressly agree that all card networks are their representatives and affiliates not in any way responsible for your Cashback.

You may opt out of transaction monitoring for the payment card you have registered at any time by removing your card on the “Linked Cards” section in the app. Neither Jux nor Fidel API will ever share your card number with a third party, and Jux employees will never ask for your card number via phone, email or support ticket. 

You will only need to provide your credit/debit card number and the expiry date of your card. We will not ask you for the CSV code printed on the reverse of your card.

It is your responsibility to ensure you enter a valid card number, neither Jux or Fidel API undertake any checks to verify if the number you’ve entered is valid or not. Furthermore, we cannot guarantee that cashback can be recovered if an invalid card number is incorrectly saved to your Jux account. 

Your registered credit/debit card must have been issued in the United Kingdom. If you register a card that has been issued from outside of the United Kingdom, you will not be eligible for cashback. 

Cashback can only be awarded to a Jux account if the offer same registered payment card is being used to pay for the purchase at the participating retailer’s store. We cannot guarantee that cashback can be recovered if a purchase is made on a card that is not registered for the Jux Cashback service at all. 

If your registered credit/debit card expires then you will need to register an alternative payment card or re-enter the new card number and expiry date for your existing card that then expired. Failure to update this information will mean you are unable to claim cashback until such time as our records are updated.

Earning Cashback – Once the authorised merchant has identified the purchase and we receive confirmation from our partner that the transaction is genuine and has been successfully processed, it will then be tracked by our systems. It will show up in your Jux account as ‘pending’. When the merchant validates the purchase, it may show in your account as ‘confirmed’. Once we have received the Cashback from the merchant, it will then show up in your Jux Balance as “Available balance”.

Whilst we take reasonable care to ensure all marketing and promotional Cashback rates are accurate, we cannot be held responsible for any inaccuracies or variations to the published rate.

If you notify us that a transaction has not been reported in your account as you anticipated (a ‘Claim’) we will use reasonable endeavours to investigate such Claim with the merchant or tracking agency subject always to our right to cease investigations at any point at our entire discretion.

You acknowledge that the merchant’s decision is final in relation to the payment of Cashback to us and in turn, our decision is final in relation to paying Cashback to you. We will make all reasonable endeavours to secure the payment of commission on a transaction but we do not and cannot make any guarantee in this regard.

In the event we do not receive the expected commission for a transaction for whatever reason, we will not be liable to pay the relevant Cashback to you. We do reserve the right to reclaim or adjust any Cashback payments in the event that any Cashback has been paid to you in error. This may include but not be limited to transactions where Cashback is not genuinely due to you or where any commission for a transaction has not been received from a retailer or its agencies but has been paid over to you as Cashback in error.

Returns and Refunds on Cashback transactions – The authorised merchants returns and refunds policies still apply to any purchases you make under an In-Store offer. You are therefore only eligible for cashback on purchases that have not been returned or refunded. If you do return a purchase after the cashback has tracked to your account, the cashback will subsequently be declined. Gift cards cannot be refunded or returned.

Jux Balance – The Jux Balance represents the total amount you have earned from Jux bonus and the Jux cashback but it does not include any pending cashback.  It is important to note that we do not hold money in your account similar to a bank and legal title to any Jux bonus or cashback earnings does not pass to you until you have taken possession of the value by way of a successful withdrawal from your Jux account. For the avoidance of doubt and notwithstanding any other provision contained in these terms and conditions, you agree and acknowledge that in all circumstances the payment of Jux bonus and/or Jux cashback to you is at our discretion and we may refuse to pay you for any reason.

Withdrawal – You can request to withdraw your available Jux Balance from your account at any time via the Jux app, but will be subject to minimum values and you may only request one pay out option in any 24-hour period.  The minimum that can be withdrawn from the Jux Bonus is £10.00. We ask that you input and check your bank details carefully, as its your responsibility to ensure that the details are correct, we shall not be responsible for withdrawals being sent to incorrect bank accounts, where you have inputted incorrect details.

If you change your bank details, there may be a delay whilst we undertake security checks before actioning your request. Withdrawals can only be made to a single bank account and may take up to 7 working days to be received. We reserve the right to suspend a withdrawal at any time without notice to you if we reasonably suspect fraudulent activity has taken place.

Purchasing Gift cards – are digital gift cards offered by other retailers/merchants, that you can purchase using Jux and receive cashback on the value of the gift card. You must purchase the gift card directly using Jux, all other purchases will not earn any cashback. Cashback may vary by merchant and can be changed at any time, but cashback will be calculated based upon what the value was at the time of the completed purchase. A completed purchase is defined as when payment has been successfully made to Jux and the merchant has issued a gift card. Payments made securely using our partner Finexer LTD who is authorised by the Financial Conduct Authority under the Payment Services Regulations 2017 firm reference number 925695 as an Authorised Payment Institution to provide account information services and payment initiation services., here you will be securely taken to your chosen banking app to authorise a payment to Jux for the purchase of the gift card. Account Closure – You can request to close your Jux account at any time, if you have any value on your Jux Balance, we will initiate a withdrawal, if you have not registered your bank details, these will be requested before the account can be closed. Any cashback that is pending when the account is closed will not be paid by the retailer.

Privacy

Any information that you submit or we collect when you are using the Jux application is subject to the Jux Privacy Policy, the terms of which are incorporated into these Terms of Service.

Limitations on Use

You must be at least 18 years old to download and use the Jux application, if you do not qualify, please do not download the Jux application.

Intellectual Property

Jux and/or its licensors are the sole owners of the Jux application, which includes any software, domains, and content made available through it. The Jux application is protected by US and International copyright and other intellectual property laws. It is for your own personal and non-commercial use only, and Jux grants you a limited license for that purpose. Without limitation, this means that you may not sell, export, license, modify, copy, reverse engineer, distribute or transmit the Jux application without Jux’s prior express written permission. Any unauthorized use of the Jux application will terminate the limited license granted by us. Jux and its graphics, logos, icons and service names related to the Jux application are registered and unregistered trademarks or trade dress of 1CARD Solutions Ltd. They may not be used without Jux’s prior express written permission. All other trademarks not owned by Jux that appear in connection with the Jux application are the property of their respective owners, who may or may not be affiliated with, connected to or sponsored by Jux.

Electronic Communications

By downloading and/or using the Jux application, you consent to receiving electronic communications and notices from 1CARD Solutions Ltd (the publisher of Jux) may also send you electronic communications and notices promoting their own similar services. You agree that any notice, agreement, disclosure or other communications that we send to you electronically will satisfy any legal communication requirements, including that such communications be in writing.

Your Conduct

By downloading and using the Jux application, you agree not to upload, post, e-mail or otherwise send or transmit any material that contains viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment associated with the Jux application. You also agree not to interfere with the servers or networks connected to the Jux application or to violate any of the procedures, policies or regulations of networks connected to the Jux application, the terms of which are incorporated herein. You also agree not to: (1) impersonate any other person while using the Jux application; (2) conduct yourself in a vulgar, offensive, harassing or objectionable manner while using the Jux application; (3) use the Jux application for any unlawful purpose; or (4) resell or export the software associated with the Jux application.

Jux does not promote, recommend or condone use of the Jux application during certain activities, such as automobile driving, where there is a significant risk of accident. You agree not to use the Jux application during such activities.

Third Party Offers

The Jux application may contain links to third party web sites or programs that are not controlled by or affiliated with Jux. Jux is not responsible for the content, offers or privacy policies of such sites and programs, including, without limitation, your redemption of such offers or a merchant’s refusal to honour any offer. Your dealings with third party sites are solely between you and the applicable third party.

Charges for Using the Jux application

Jux currently provides the Jux application to you free of charge. However, when you use the Jux application, you may be subject to charges imposed by your wireless or other applicable carrier. Payment of such charges is solely your responsibility. The Jux application may not be accessible in some foreign countries, this will depend on the Jux application being supported by the foreign network. You should check with the local carrier whether you will be required to pay additional charges for such access. The ability to download or access the Jux application may be restricted or impaired when on a roaming network abroad

Use of Information Submitted

You agree that Jux is free to use any comments, information or ideas contained in any communication you may send to Jux without compensation, acknowledgement or payment to you for any purpose whatsoever, including, but not limited to, developing, manufacturing and marketing products and services and creating, modifying or improving the Jux application or other products or services.

No Warranty & Liability Limit

Jux provides the Jux application “as is” and without any warranty or condition, whether express, implied or statutory. Jux specifically disclaims any implied warranties of title, merchantability, fitness for a particular purpose and non-infringement. Jux assumes no liability or responsibility for any errors or omissions in the Jux application; any failures, delays or interruptions in the Jux application; any losses or damages arising from the use of the Jux application, including, without limitation, any damage to your mobile device; or any conduct by users of the Jux application. We reserve the right to deliver the Jux application in our sole and absolute discretion.

In no event shall Jux, its shareholders, directors, officers, employees or agents be liable (jointly or severally) to you for loss of use or any special, incidental, indirect or consequential damages arising out of or in connection with the Jux application or these terms of service, on any theory of liability, and whether or not advised of the possibility of damage. If any applicable authority holds any portion of this section to be unenforceable, then liability will be limited to the fullest possible extent permitted by applicable law.

Indemnity

You agree to indemnify and hold Jux and its related companies, and each of their respective shareholders, directors, officers, employees, agents and merchant partners harmless from and against any third-party claim or cause of action, including reasonable attorneys’ fees and court costs, arising, directly or indirectly, out of your use of the Jux application or your violation of any law or the rights of any third party. Particular note is with American Express Crediting Service, when using the Jux Cashback service, you agree to release of all claims against American Express and its representatives and affiliates, with American Express being a third-party beneficiary of such release.

Disputes

Governing Law – You agree that these terms of service or any claim, dispute or controversy (whether in contract, tort or otherwise, whether pre-existing, present or future, and including statutory, common law and equitable claims) between you and Jux arising from or relating to these Terms of Service, their interpretation or breach, termination or validity, the relationships which result from these Terms of Service, the Jux application, Jux’s advertising or any related transaction shall be governed by and construed in accordance with the laws of the UK.

 

General

If any provision of these Terms of Service is held to be invalid or unenforceable, such provision shall be struck, and the remaining provisions shall be enforced. Headings are for reference purposes only and in no way define, limit, construe or describe the extent or scope of such section. Our failure to enforce any provision of these Terms of Service shall not constitute a waiver of that or any other provision. These Terms of Service set forth the entire understanding and agreement between you and Jux with respect to the subject matter hereof.
